{"id":36709,"date":"2023-09-25T08:35:01","date_gmt":"2023-09-25T06:35:01","guid":{"rendered":"https:\/\/bird.bg\/?p=36709"},"modified":"2025-03-01T20:49:18","modified_gmt":"2025-03-01T19:49:18","slug":"rail-infra-mirinski","status":"publish","type":"post","link":"https:\/\/bird.bg\/en\/rail-infra-mirinski\/","title":{"rendered":"A state-owned company whitewashes the damage from a failed railway project for BGN 120 million."},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The National Railway Infrastructure Company (<\/span><b>NRIC<\/b><span style=\"font-weight: 400;\">) has quietly assigned construction works on the modernization of the railway line Sofia &#8211; Elin Pelin to &#8220;<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=205677435\"><span style=\"font-weight: 400;\">Transport Construction and Rehabilitation<\/span><\/p>\n<p><\/a>&#8220;<span style=\"font-weight: 400;\">&#8221; \/TCP\/, a company under the umbrella of the Ministry of Transport. This works entirely in the interests of the failed initial contractor &#8211; the consortium &#8220;<\/span><a href=\"https:\/\/reports.bulstat.bg\/bulstat-ireports\/frameset?__report=https%3A%2F%2Freports.bulstat.bg%2Fbulstat-ireports%2Fv_rpt1.rptdesign&amp;__format=html&amp;uic=177077761&amp;__overwrite=true&amp;__locale=bg&amp;__svg=true&amp;__designer=false\"><br \/>\n  <span style=\"font-weight: 400;\">Kelette AB<\/span><br \/>\n<\/a><span style=\"font-weight: 400;\">&#8221; DZZD, associated with the interests of <\/span><b>Ivan Mirinski<\/b><span style=\"font-weight: 400;\"> and <\/span><b>Delyan Peevski<\/b><span style=\"font-weight: 400;\">. Moreover, companies associated with Kellett have also lined up for the new tender for the scandalously failed railway project, costing  <\/span><b>BGN 120 million<\/b><span style=\"font-weight: 400;\"> to the European taxpayer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sofia-Elin Pelin project was <\/span><a href=\"https:\/\/scan.bird.bg\/contracts\/?v=view&amp;id=174898\"><span style=\"font-weight: 400;\">won<\/span><\/p>\n<p><\/a> and <span style=\"font-weight: 400;\"> started by a consortium between the Hungarian <\/span> company <a href=\"http:\/\/kelet-ut.hu\/\"><span style=\"font-weight: 400;\">Kelet-Ut<\/span><\/p>\n<p><\/a><span style=\"font-weight: 400;\"> and the Haskovo construction company AB<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=836014515\"><span style=\"font-weight: 400;\"><\/p>\n<p><\/span><\/a><span style=\"font-weight: 400;\">&#8221; Jsc . Part of the contract was <a href=\"https:\/\/app.eop.bg\/today\/293179\"><br \/>\n  <strong>awarded<\/strong><br \/>\n<\/a> to the state  <\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=205677435\"><br \/>\n  <span style=\"font-weight: 400;\">TSA<\/span><br \/>\n<\/a><span style=\"font-weight: 400;\">, which has to implement it with budgetary resources. <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">In parallel, the contractor<\/span> &#8220;<a href=\"https:\/\/reports.bulstat.bg\/bulstat-ireports\/frameset?__report=https%3A%2F%2Freports.bulstat.bg%2Fbulstat-ireports%2Fv_rpt1.rptdesign&amp;__format=html&amp;uic=177077761&amp;__overwrite=true&amp;__locale=bg&amp;__svg=true&amp;__designer=false\"><span style=\"font-weight: 400;\">Kellett AB<\/span><\/p>\n<p><\/a><span style=\"font-weight: 400;\">&#8221; sues <\/span><a href=\"https:\/\/www.rail-infra.bg\/\"><span style=\"font-weight: 400;\">NRIC<\/span><\/p>\n<p><\/a><span style=\"font-weight: 400;\">, claiming enormous damage. Thus, despite the obvious scandal with the non-fulfillment of the contract, Kellett AB is in a favorable situation:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">She has absorbed almost the entire budget to do a very small (and completely dysfunctional) piece of work.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The GFF will carry out the works that the consortium has not carried out. After that, no one will know who did what and when, as there are no officially signed documents for the undone works.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Third, Kellett AB claims damages in court and is very likely to win because it can still count on &#8220;full support&#8221; from NRIC, which is doing everything it can to lose.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">The &#8220;Black Box&#8221; TSV as the scheme &#8220;Motorways&#8221;<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">However, the inclusion of the GFF does not only serve to cover up traces and complete work that must have already been done. Both in the past and today, this company serves as a &#8220;<\/span><i><br \/>\n  <span style=\"font-weight: 400;\">Black Treasury&#8221;<\/span><br \/>\n<\/i><span style=\"font-weight: 400;\"> for problematic contracts in the Bulgarian railways and not only. <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">The same company &#8220;did the work&#8221; on the dredging of the port of Varna, without having a single ship, but only as an intermediary in order to obtain a Russian company a huge state contract financed with European money.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the case of NRIC, the TSV acts differently. The GFF receives state subsidies every year to maintain a certain number of personnel and equipment, as it has to provide urgent repairs to critical transport infrastructure in the event of an emergency.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Accidents become rare, but the technique does not collect dust, on the contrary. The company selectively helps NRIC contractors who are troubled with their projects by providing them with the necessary resources. GFF services are paid at prices far below the market prices, but it is close to the mind that there may also be a hidden price in the form of commissions for decision-makers in the Ministry of Transport and NRIC.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also applied <\/span><b>in house<\/b><span style=\"font-weight: 400;\">  the scheme, which became popular in the road sector with the internal contracts of the state-owned company Avtomagistrali for the construction of Hemus Motorway. As a state-owned company, TSV receives the award without tender of large contracts at a very good price. The works are then subcontracted, which are carefully selected Bulgarian construction companies, ready to pay large commissions to all decision-makers reaching a mind-boggling 50% or more of the value of the subcontractor.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the case of the project for modernization of the railway line Sofia \u2013 Elin Pelin, TSV currently plays both roles:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Currently, the TSV is performing works that are supposed to have been carried out long ago by Kellett AB, allowing them to claim that these same works were done by themselves. Currently, Kellett AB and NRIC are still in litigation and there is no agreement between the parties on which works are being carried out.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">NRIC assigned without a tender to TSV to complete the section Sofia \u2013 Iskar at a very good price and with a very unclear scope.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It is an open secret that all these schemes are controlled and set in motion by the Almighty  <\/span><b>Ivan Mirinski<\/b><span style=\"font-weight: 400;\">, right hand of  <\/span><b>Penalties under the law<\/b><span style=\"font-weight: 400;\">  &#8220;<\/span><b>Magnitsky<\/b><span style=\"font-weight: 400;\">&#8221;  <\/span><b>Delyan Peevski<\/b><span style=\"font-weight: 400;\">, who for many years was the formal owner of &#8220;<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=119081953\"><span style=\"font-weight: 400;\">Vodstroy 98<\/span><\/a><span style=\"font-weight: 400;\">&#8220;, subsequently renamed &#8220;<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=119081953\"><span style=\"font-weight: 400;\">VDH<\/span><\/a><span style=\"font-weight: 400;\">&#8221; AD and bought by Varna &#8220;<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=103029862\"><span style=\"font-weight: 400;\">Hydrostroy<\/span><\/a><span style=\"font-weight: 400;\">&#8221; AD on  <\/span><b>Veliko Zhelev<\/b><span style=\"font-weight: 400;\">. Mirinski is not present in the Haskovo company AB AD, which, according to the Capital newspaper, is &#8220;the new builder of Peevski&#8221;. Mirinski&#8217;s role in the last 10-15 years under various governments has been at a &#8220;marshalling yard&#8221; for money in the infrastructure construction sector (especially the railways) in Bulgaria.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">New player under the old &#8220;Hungarian scheme&#8221;<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The selection of the Kellet AB consortium in 2015 was perceived as extremely scandalous in the industry, as solid companies with extensive experience in infrastructure construction were removed from the tender, including Austria&#8217;s Porr Bau, state-owned Trakcja PRKiI S.A. (Poland), Strabag Rail (Austria), Yap\u0131 Merkezi \u0130n\u015faat (Turkey) and others.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even then, it became clear that the Hungarian partner, the company Kelet-\u00dat, had seriously exaggerated its role in the implementation of railway projects in Hungary. A simple check shows that Kelet-\u00dat has completed works for only 12% of the T\u00e1rnok-Sz\u00e9kesfeh\u00e9rv\u00e1r railway modernisation project and not the whole project. However, the evaluation committee of the tender accepted the reference that Kelet-\u00dat had built almost the whole section itself.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The situation is about to be reproduced with <\/span> the <a href=\"https:\/\/app.eop.bg\/today\/271188\"><b>new tender<\/b><\/p>\n<p><\/a><span style=\"font-weight: 400;\">  for the section Iskar &#8211; Elin Pelin. He has attracted only two offers, one from companies related to Porr Bau, which are already working on the Sofia-Voluyak project, and the other is from the&#8230; Hungarian-Bulgarian Consortium &#8220;<\/span><b>Iskar 2023<\/b><span style=\"font-weight: 400;\">&#8221; <\/span><b>DZZD.<\/b><span style=\"font-weight: 400;\"><\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to our media, in the new DZZD partners are the Bulgarian &#8220;<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=203128975\"><span style=\"font-weight: 400;\">United Group<\/span><\/a><span style=\"font-weight: 400;\">&#8220;, which has no experience in infrastructure construction, &#8220;<\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=205118392\"><span style=\"font-weight: 400;\">RailRun Bulgaria<\/span><\/a><span style=\"font-weight: 400;\">&#8220;, which is backed by an Austrian lawyer Fiduciary and Hungary&#8217;s Homlok F\u0151v\u00e1llalkoz\u00f3 Kft., which is only known to have been registered in early 2023 with EUR 8,000 in capital. The Commercial Register shows that the former owner of &#8220;United Group&#8221;  <\/span><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=1ef1a2aa46c60b7f0f64575074bb7917d1cff4c500a6a76f7f37a39e535a15df\"><span style=\"font-weight: 400;\">Iliyan Tasev<\/span><\/a><span style=\"font-weight: 400;\">  is linked to Kelet-\u00dat through the firm Bulgarian concrete elements.<\/span><\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-35128 size-full\" src=\"https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=1320%2C611&#038;ssl=1\" alt=\"\" width=\"1320\" height=\"611\" srcset=\"https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?w=1566&amp;ssl=1 1566w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=300%2C139&amp;ssl=1 300w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=1024%2C474&amp;ssl=1 1024w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=768%2C356&amp;ssl=1 768w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=1536%2C711&amp;ssl=1 1536w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=1200%2C556&amp;ssl=1 1200w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=990%2C458&amp;ssl=1 990w, https:\/\/i0.wp.com\/bird.bg\/wp-content\/uploads\/2023\/09\/00233-2023-0034.png?resize=1320%2C611&amp;ssl=1 1320w\" sizes=\"auto, (max-width: 1320px) 100vw, 1320px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">So far, the Iskar 2023 consortium DZZD has not been allowed to continue the procedure due to non-compliance with the requirements and selection criteria, according to a protocol of the tender committee dated 04.09.2023.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the scheme may be stalling. Last week, the entire NRIC leadership was fired, without giving reasons, but no wonder this is related to  <\/span><i><span style=\"font-weight: 400;\">in house<\/span><\/i><span style=\"font-weight: 400;\">  the assignment of the GFF described above. In addition, the European Public Prosecutor&#8217;s Office is likely to intervene and investigate those responsible for this massive theft of European funds.
