{"id":36721,"date":"2023-09-13T10:08:23","date_gmt":"2023-09-13T08:08:23","guid":{"rendered":"https:\/\/bird.bg\/?p=36721"},"modified":"2025-03-01T20:48:20","modified_gmt":"2025-03-01T19:48:20","slug":"fibank-mondeshki","status":"publish","type":"post","link":"https:\/\/bird.bg\/en\/fibank-mondeshki\/","title":{"rendered":"Mondeshki &#8211; &#8220;Peevski&#8217;s Trojan Horse&#8221;, filled with millions by FIB"},"content":{"rendered":"<p><span style=\"font-weight: 400\">Lawyer <\/span><b>Momchil Mondeshki<\/b><span style=\"font-weight: 400\"> received <\/span><b>BGN 16.3 million<\/b><span style=\"font-weight: 400\"> between 2014 and 2018 from First Investment Bank (<\/span><b>FIB)<\/b><span style=\"font-weight: 400\">), also known as FiBank, without appearing at any of their cases. Officially, the money was paid to him.&#8221;<\/span><b>advise<\/b><span style=\"font-weight: 400\">&#8221; <\/span><b>court cases of the bank<\/b><span style=\"font-weight: 400\">. However, the fees of over BGN 1 million for consultation seem like a means of paying money from the bank through a &#8220;legal&#8221; way, which will subsequently serve as a bribe. Mondeshki&#8217;s money was paid by FIB and in connection with the bank&#8217;s notorious affair with  <\/span><b>The stolen 22 million euros from <\/b><span style=\"font-weight: 400\">the Romanian Agency for Payment and Participation in Agriculture (APIA). <\/span><span style=\"font-weight: 400\">In addition, Mondeshki has received hundreds of thousands from a company associated with Peevski.<\/span><span style=\"font-weight: 400\"> This is understood by documents available to BIRD.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In the last 15 years of our transition, the judiciary in Bulgaria apparently functions with the help of the so-called &#8220;<\/span><b>influence brokers&#8221;.<\/b><span style=\"font-weight: 400\">&#8220;. The characters with nicknames, and not only: Krasimir Georgiev &#8211;  <\/span><b>Krasio Cherniya<\/b>, <span style=\"font-weight: 400\">Petyo Petrov <\/span> &#8211; <b>Pepi The Euro<\/b>, <span style=\"font-weight: 400\">entrepreneur <\/span><b>Ivan Mirinski<\/b>, <span style=\"font-weight: 400\">Martin Bojanov &#8211; <\/span><b>Notary<\/b> and <b>Kalin Chankov<\/b> and the <span style=\"font-weight: 400\">former judge and current lawyer <\/span><b>Velimir Atanasov<\/b>, who gained popularity in the case <b><a href=\"https:\/\/bird.bg\/geshev-josi-2\/\">Josi,<\/a><\/p>\n<p><\/b> who gained <span style=\"font-weight: 400\"> popularity in the <\/span> case <span style=\"font-weight: 400\"> <\/span><span style=\"font-weight: 400\"> <\/span><span style=\"font-weight: 400\">. More details about them are available below in our publication. In this &#8220;elite&#8221; group of &#8220;brokers of influence&#8221; falls and lawyer  <\/span><b>Momchil Petkov Mondeshki<\/b><span style=\"font-weight: 400\">.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">A check by the NRA reveals BGN 16.3 million. by FIB<\/span><\/h2>\n<p><b>Momchil Mondeshki<\/b><span style=\"font-weight: 400\"> was checked by the NRA as an individual for the period from January 1, 2014 to December 31, 2018, i.e. for<\/span><b>a 5-year period<\/b><span style=\"font-weight: 400\">. The inspection is carried out by the territorial directorate in Veliko Tarnovo and was carried out from 26.06.2019 to 30.09.2020.<\/span> <span style=\"font-weight: 400\"> Inspection report under No PF-04001119000711-073-001\/30.09.2020 sheds light on <\/span><b>the actual scope<\/b><span style=\"font-weight: 400\">, with whom Mondeshki works. Only through  <\/span><span style=\"font-weight: 400\">In 2014, as a freshly registered lawyer, he received over BGN 9 million. fees from FIB. For the period 16.05.2014 &#8211; 31.12.2014  <\/span><b>Mondeshki has received a total of BGN 16,302,450.27 from FIB.<\/b><span style=\"font-weight: 400\"><\/span><\/p>\n<p><span style=\"font-weight: 400\">A small but significant detail is that when FIB started pouring money into the accounts of the freshly registered lawyer, he enjoyed the reputation of one of the most successful brokers in the Sofia City Court (SCC). It is very close to  <\/span><b>Vladimira Yaneva<\/b><span style=\"font-weight: 400\"> and next to <\/span><b>Rumyana Chenalova<\/b><span style=\"font-weight: 400\">. Proximity verified through records from  <\/span><span style=\"font-weight: 400\"><strong>#\u042f\u043d\u0435\u0432\u0430\u0413\u0435\u0439\u0442<\/strong><\/span><span style=\"font-weight: 400\">. FIB&#8217;s payments give indications that Mondeshki has apparently &#8220;lobbied&#8221; on their court cases in Sofia, Stara Zagora, and probably in Shumen, and it is very possible that this happened with the protection and contacts of the two judges.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Apparently, the #<\/span><b>Yaneva Gate<\/b> scandal <span style=\"font-weight: 400\">that <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/bivol.bg\/badapples-talking-s1-1.html\">started<\/a><\/p>\n<p><\/span><span style=\"font-weight: 400\">  in early November 2015, he did not fatally influence Mondeshki and did not scare FIB so much that they would give up his &#8220;services&#8221;. In 2015 and 2016, Mondeshki&#8217;s revenues from FIB were more modest, about half a million leva, but in 2017 he received BGN 3,566,996&nbsp;from the bank, and in 2018 BGN 1,349,522&nbsp;.<\/span><\/p>\n<p><span style=\"font-weight: 400\">For 5 years <\/span><b>Momchil Mondeshki<\/b><span style=\"font-weight: 400\">  receives 42 payments from FIB. Their value varies from several tens of thousands of leva (at least) to the impressive  <\/span><b>over BGN 1.5 million one-time payment<\/b><span style=\"font-weight: 400\">  to his bank account. Mondeshki &#8216;s<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400\">It is very curious <\/span><b>what exactly FIB paid Mondeshki for<\/b><span style=\"font-weight: 400\">, provided that even today no one has seen the lawyer in the courtroom, as a legal representative. He has not appeared in the cases of FIB or in any other case. The only qualities in which Mondeshki appeared in the courtroom was as a defendant and as a convict. Despite his biography as a rehabilitated criminal, he received millions from FIB. These are officially fees for his lawyer services \u2013  <\/span><b>Consultations<\/b> on the cases <span style=\"font-weight: 400\"> related to the Bank&#8217;s cases.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Mondeshki &#8220;advises&#8221; FIB on how to avoid the return of the stolen 22 million euros from Romania<\/span><\/h2>\n<p><span style=\"font-weight: 400\">In January 2017 <\/span><b>Momchil Mondeshki<\/b><span style=\"font-weight: 400\"> and First Investment Bank (<\/span><b>FIB<\/b><span style=\"font-weight: 400\">) agree that he will receive a total <\/span> of EUR <b>2 755 000<\/b><span style=\"font-weight: 400\"> excluding VAT if he manages to help the bank avoid the return of the <\/span><b>stolen EUR 22 million<\/b><span style=\"font-weight: 400\">. Mondeshki is committed to dealing with  <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/bivol.bg\/pib-zapor-apia-2.html\">The lawsuits<\/a><\/span><span style=\"font-weight: 400\">  against FIB, filed by the Ministry of Agriculture and Food of the Republic of Romania, through the Agency for Payment and Participation in Agriculture (APIA). For the implementation of item 1.1.4 are agreed  <\/span><b>EUR 450<\/b> 000 <span style=\"font-weight: 400\"> excluding VAT plus <\/span><b>another EUR 25 000<\/b><span style=\"font-weight: 400\">  without VAT for execution within a certain period. The point in question requires the achievement of &#8220;positive&#8221; for the contracting authority final decisions in Commercial Case No 2451\/2016 on the inventory of the Supreme Court of Cassation, with the subject of an application for annulment of the Order of June 9, 2014 under the city of Sofia. e. No 4919\/2014 of the SCC. I d.o., I Chamber, confirmed by decision No 937 of 8 May 2015 No 4018\/2014 of the Sofia Court of Appeal, Civil Division, 2nd Chamber, which was not admitted to cassation appeal by Order No 646 of 27 July 2016 under item No 2844\/2015 of the SCC. For success in this commercial case No. 2451\/2016 of the Supreme Court of Cassation, the parties agree that it means a ruling by the court by a final judicial decision, which leaves the application for annulment inadmissible as inadmissible. For success under item 1.1.6 have been agreed separately more  <\/span><b>EUR 100 000<\/b><span style=\"font-weight: 400\"> excluding VAT.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The main object of interest to FIB under this contract are the following cases:<br \/>\n<\/span><span style=\"font-weight: 400\">1. Commercial case No <\/span><span style=\"font-weight: 400\"><a href=\"http:\/\/www.vks.bg\/pregled-akt?type=ot-delo&amp;id=D95A1CF4F05998B8C22580B80044CA33\">2499\/2016<\/a><\/p>\n<p><\/span> of <span style=\"font-weight: 400\"> the Supreme Court of Cassation (SCC).<br \/>\n<\/span><span style=\"font-weight: 400\">2. Civil Case No <\/span><span style=\"font-weight: 400\"><a href=\"http:\/\/194.12.227.30\/BCAP\/AC\/WebData.nsf\/vCourtActsByCase\/5B42CC3CC6B69EB9C22580DD0035B0D8\">127\/2017<\/a><\/p>\n<p><\/span><span style=\"font-weight: 400\"> of the Sofia Court of Appeal (CAC).<br \/>\n<\/span><span style=\"font-weight: 400\">3. Annulment sought of decisions under item e. No 2375\/2014 of the SAS and so on. \u2116  <\/span><span style=\"font-weight: 400\"><br \/>\n  <a href=\"http:\/\/www.vks.bg\/pregled-akt?type=ot-delo&amp;id=CAAD6B1C43EB48A1C225805700263A7F\">233\/2016<\/a><br \/>\n<\/span><span style=\"font-weight: 400\"> of the SCC.<br \/>\n<\/span><span style=\"font-weight: 400\">4. Seeking annulment of decisions under the city of Plovdiv. E. \u2116  <\/span><span style=\"font-weight: 400\"><a href=\"http:\/\/194.12.227.30\/BCAP\/AC\/WebData.nsf\/vCourtActsByCase\/412F73C72CDF4401C2257E4C002F9794\">4018\/2014<\/a><\/span><span style=\"font-weight: 400\">  of the SAS, t. d. \u2116  <\/span><span style=\"font-weight: 400\"><a href=\"http:\/\/www.vks.bg\/pregled-akt?type=ot-delo&amp;id=4937FA5C1CC69FC5C2257FFD003B9B2F\">2844\/2015<\/a><\/span><span style=\"font-weight: 400\">  of the SCC and t. d. \u2116  <\/span><span style=\"font-weight: 400\"><br \/>\n  <a href=\"http:\/\/www.vks.bg\/pregled-akt?type=ot-delo&amp;id=87BA3E1C298A4B4FC22581FD0028B1D3\">2451\/2016<\/a><br \/>\n<\/span><span style=\"font-weight: 400\"> of the SCC.<br \/>\n<\/span><span style=\"font-weight: 400\">5. Seeking annulment of decisions under the city of Sofia. \u2116  <\/span><span style=\"font-weight: 400\"><a href=\"http:\/\/194.12.227.30\/BCAP\/AC\/WebData.nsf\/vCourtActsByCase\/856E9F46A401DE82C2257E110035D740\">3427\/2014<\/a><\/span><span style=\"font-weight: 400\">  of the SAS, Fr. E. \u2116  <\/span><span style=\"font-weight: 400\"><a href=\"http:\/\/www.vks.bg\/pregled-akt?type=ot-delo&amp;id=088968058146BE46C2257F330042D283\">3166\/2015<\/a><\/span><span style=\"font-weight: 400\">  of the SCC and Fr. E. \u2116  <\/span><span style=\"font-weight: 400\"><br \/>\n  <a href=\"http:\/\/www.vks.bg\/pregled-akt?type=ot-delo&amp;id=A35767CAAD6E3CA2C22581700046EC8F\">3156\/2016<\/a><br \/>\n<\/span><span style=\"font-weight: 400\"> of the SCC.<br \/>\n<\/span><span style=\"font-weight: 400\">6. Protection of the actions of PEAs, gr. E. \u2116  <\/span><span style=\"font-weight: 400\"><br \/>\n  <a href=\"https:\/\/legalacts.justice.bg\/Search\/GetActContentByActId?actId=IHtIJQk1MgM%3D\">256\/2017<\/a><br \/>\n<\/span><span style=\"font-weight: 400\"> of the Sofia City Court.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The contract envisages that three days after the signing, <\/span><b>Momchil Mondeshki<\/b><span style=\"font-weight: 400\"> will receive an <\/span><b>advance<\/b><span style=\"font-weight: 400\"> <\/span> of <b>EUR 650,000<\/b><span style=\"font-weight: 400\"> excluding VAT from FIB.&nbsp;<\/span><\/p>\n<p>In 2019, however, FIB <span style=\"font-weight: 400\"><a href=\"https:\/\/www.vks.bg\/pregled-akt.jsp?type=ot-delo&amp;id=AF8C2F954FC49D06C22583900043BF5B\">finally lost<\/a><\/p>\n<p><\/span><span style=\"font-weight: 400\"> before the Supreme Court of Cassation Commercial Case <\/span> No. 3132\/2017<span style=\"font-weight: 400\">, initiated on FIB&#8217;s application for revocation of an enforceable decision to pay a <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/bivol.bg\/pib-zapor-apia-2.html\">bank guarantee<\/a><\/p>\n<p><\/span> No. 000LG-L-003436 <span style=\"font-weight: 400\"> \/31.07.2012 on the amount of EUR 22,033,854.39<\/span><b>.<span style=\"font-weight: 400\"> <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/www.vks.bg\/pregled-delo.jsp?id=e0fe6ac15d4ddf10c225768000409ffe\/d13a0aa5ff4260bdc22581fa00287152\"><\/p>\n<p><\/a><\/span><\/b><span style=\"font-weight: 400\">  and the cost of enforcement against the bank. Mondeshki is committed to stopping the actions of  <\/span><span style=\"font-weight: 400\">the private enforcement agent Ulyana Dimolarova&nbsp;against FIB, but this does not happen either. At that time, FIB was faced with the hypothesis  <\/span>to transfer <b>over EUR 22 million<\/b> <span style=\"font-weight: 400\">to the Romanian Ministry of Agriculture <\/span><span style=\"font-weight: 400\">  a bank guarantee owed as collateral for a food transaction. In practice, the bank engaged Mondeshki for 12% of the amount sought by the Romanians, but he did not achieve success. What else but a corrupt deal could be hiding behind this contract? Subsequently, FIB  <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/www.fibank.bg\/bg\/za-nas\/novini\/novini\/pyrva-investicionna-banka-specheli-okonchatelno-sydebnija-spor-v-rumynija-s-rumynskata-agencija-za-razplashtanija-i-intervencija-v-zemedelieto-apia\">announced<\/a><\/p>\n<p><\/span> <span style=\"font-weight: 400\">that they had won 3 cases before the Romanian court and had lifted the distraints in their accounts with the BNB, but failed before the Supreme Court of Cassation with their consultant Monde\u0161ki.<\/span><\/p>\n<p>The FIB <span style=\"font-weight: 400\">documents show that on 12.06.2014 they paid Mondeshki BGN 977,915&nbsp;for &#8220;legal protection and court&#8221; in civil cases 4919\/2014, 4920\/2014, 4921\/2014, all led by FIB against <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=200506505\">VM Corporation<\/a><\/p>\n<p><\/span><span style=\"font-weight: 400\">. Mondeshki received almost the same amount on 13.06.2014 for consulting FIB on a commercial case, again against VM Corporation. The company is a participant in the infamous scheme of draining the Romanian agricultural paying agency APIA. In 2015, the owner of the company \u2013 Valeri Miloradov Petrov  <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/bivol.bg\/fibank-apia-2.html\">Announced<\/a><\/span><span style=\"font-weight: 400\">Not him, but FIB operated with his company. First Investment Bank gives bank guarantees amounting to 31 million euros to the company to participate in a tender for the supply of oil and flour to the poor, organized by the Romanian agency. The auction was won by VM Corporation, the money was taken in advance, but food was not delivered. The deal became infamous as  <\/span><span style=\"font-weight: 400\"><strong>The Biggest Single Theft of EU Funds<\/strong><\/span><span style=\"font-weight: 400\">, carried out with the complicity of the bank. For example, a consulting contract 074470 of 20.06.2014 worth  <\/span><b>&nbsp;1 100 000&nbsp;EUR<\/b><span style=\"font-weight: 400\">  in commercial case 565\/2011 in the General Assembly of Stara Zagora. The case is a proceeding in bankruptcy of &#8220;<\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=121191182\">Stenstroy Engineering<\/a><\/span><span style=\"font-weight: 400\">&#8216; and FIB claimed an amount of EUR 8 650 000. By virtue of  <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/bganaliz.com\/vks\/opredelenie-443-ot-4-7-2019-po-tr-delo-2831-2831-na-2-ro-tr-otdelenie-trgovska-kolegiya-na-vks\/\">promissory note<\/a><\/span><span style=\"font-weight: 400\">  from 22.08.2008 &#8220;Stenstroy Engineering&#8221; Ltd. has undertaken unconditionally and irrevocablely, upon presentation of the promissory note by 30.10.2012, to pay to First Investment Bank AD an amount of EUR 8 650 000. Mondeshki is included when the bankruptcy estate is distributed. The amount of the fee of BGN 1 100 000 suggests that in connection with this case some corrupt transaction has been effected by which the bank was benefited in the distribution of the bankruptcy estate. The legal representation itself in such a commercial case with a material interest of about BGN 16,867,500. The minimum legal fee should be in the range between BGN 140,000 and just under BGN 300,000, depending on the stage of bankruptcy in which the lawyer is involved. In history, however, there is probably no consulting fee of BGN 1,100,000. in a case with a material interest of BGN 16 954 000<\/span><\/p>\n<p><span style=\"font-weight: 400\">The situation with the fees paid by FIB to Mondeshki becomes even more disturbing, with the fee again of <\/span><b>BGN 1,100,000&nbsp;&nbsp;<\/b><span style=\"font-weight: 400\">. paid by contract 074471 for consultations in enforcement case 2085\/2014  <\/span><b>PEA Stoyan Yakimov<\/b><span style=\"font-weight: 400\">. The latter is very close to  <\/span><b>Delyan Peevski<\/b><span style=\"font-weight: 400\"> and has long been a priority PEA in <\/span><span style=\"font-weight: 400\"><br \/>\n  <a href=\"https:\/\/www.svobodnaevropa.bg\/a\/30064733.html\">the sale<\/a><br \/>\n<\/span> <b>of Corpbank&#8217;s assets<\/b><span style=\"font-weight: 400\">. According to insiders, he studied law in the same stream with Peevski&#8217;s lawyer  <\/span><b>Alexander Angelov<\/b><span style=\"font-weight: 400\">. It is also an indisputable fact that Kristi Marinova, appointed trustee in bankruptcy of CCB, was Mondeshki&#8217;s accountant, and Angel Donov, also a trustee in bankruptcy at the bank, worked together on cases of the Mondeshki family. Banevi.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Again, apparently the sacred amount of <\/span><b>BGN 1,100,000&nbsp;&nbsp;.<\/b><span style=\"font-weight: 400\">  was paid to lawyer Mondeshki from FIB under a contract 074472 for consultation on commercial case 212\/2014 of the General Assembly of Stara Zagora. The case is again a bankruptcy proceeding of &#8220;<\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/scan.bird.bg\/tr\/?v=view&amp;guid=123155993\">Remotex &#8211; Radnevo<\/a><\/span><span style=\"font-weight: 400\">&#8221; EAD. The history of FIB and Remotex is public. In 2014, the Bank  <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/www.actualno.com\/starazagora\/remoteks-veche-e-sobstvenost-na-banka-news_55406.html\">acquires the assets<\/a><\/span><span style=\"font-weight: 400\">  of the bankrupt company. According to publications from that time, FIB paid at auction the amount of nearly 9 mln. Lv. and becomes the owner of the major part of the assets of the bankrupt company. The bank has lent the plant for the repair of heavy mining equipment with nearly 16m euros. Lv. before the insolvency procedure begins. The question is why FIB paid the sum of BGN 1&nbsp;100 000&nbsp;to Mondeshki in connection with this case.<\/span><\/p>\n<p><span style=\"font-weight: 400\">We sought a comment from FIB on Mondeshki&#8217;s consulting fees, but such did not follow. The bank noted that its activities are subject to serious control, but did not explain why they use the services of a rehabilitated criminal.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Influence brokers<\/span><\/h2>\n<p><span style=\"font-weight: 400\">In the last 15 years of our transition, the judiciary in Bulgaria apparently functions with the help of the so-called &#8220;<\/span><b>influence brokers&#8221;.<\/b><span style=\"font-weight: 400\">&#8220;. One of the names that became a byword in the judicial circles after 2009 is that of  <\/span><b>Krasimir Georgiev &#8211; Krasio the Black<\/b><span style=\"font-weight: 400\">. It continues to be relevant in circles and today is considered a link between shady businessmen and administrative judges. He gained contacts along with the repairs in various buildings of the judiciary.<\/span><\/p>\n<p><span style=\"font-weight: 400\"><a href=\"https:\/\/www.capital.bg\/politika_i_ikonomika\/pravo\/2023\/07\/05\/4503303_istinskoto_pravosudie_grupi_kato_na_petyo_evroto\/\">A publication<\/a><\/p>\n<p><\/span> of <span style=\"font-weight: 400\"> Capital mentions the mediation role of <\/span><b>Martin Bojanov &#8211; the Notary<\/b><span style=\"font-weight: 400\"> <\/span> and <b>Kalin Chankov<\/b> and the <span style=\"font-weight: 400\">former judge and current lawyer <\/span><b>Velimir Atanasov<\/b>, <span style=\"font-weight: 400\"> who gained popularity in the <\/span><b><a href=\"https:\/\/bird.bg\/geshev-josi-2\/\">case Josi.<\/a><\/p>\n<p><\/b><span style=\"font-weight: 400\">. In addition to the Romanian affair, he seems committed to fixing up problems in the United States.
