{"id":49254,"date":"2024-01-08T14:05:27","date_gmt":"2024-01-08T13:05:27","guid":{"rendered":"https:\/\/bird.bg\/?p=49254"},"modified":"2025-03-01T20:44:29","modified_gmt":"2025-03-01T19:44:29","slug":"arbitrages-acf-renewable-energy","status":"publish","type":"post","link":"https:\/\/bird.bg\/en\/arbitrages-acf-renewable-energy\/","title":{"rendered":"Bulgaria Lost Another EUR 70 Million from Another Arbitration"},"content":{"rendered":"<p><b>Bulgaria lost another <\/b><a href=\"https:\/\/icsid.worldbank.org\/cases\/case-database\/case-detail?CaseNo=ARB\/18\/1\"><b>case<\/b><\/a><span style=\"font-weight: 400;\"> in the World Bank Arbitration Court (<\/span><a href=\"https:\/\/icsid.worldbank.org\/\"><span style=\"font-weight: 400;\">ICSID)<\/span><\/a> <span style=\"font-weight: 400;\">in Washington and <strong>was <\/strong><\/span><b>sentenced to pay a total of more than 70 million euros<\/b><span style=\"font-weight: 400;\">, of which EUR 65 million in principal and interest as of 2019, as well as the claimant&#8217;s legal costs. The Ministry of Finance will also have to pay in full its own legal costs, which, according to our data, are at least another 5 million euros. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The subject of the case is an investment in photovoltaic parks of a Maltese company, backed by Saudi owners, according to <\/span><a href=\"https:\/\/www.dnevnik.bg\/biznes\/2018\/02\/28\/3137855_chetvurta_energiina_kompaniia_zavede_delo_sreshtu\/\"><span style=\"font-weight: 400;\">information<\/span><\/a><span style=\"font-weight: 400;\">  of Dnevnik. The company refers to its violated rights under the Energy Charter Treaty, signed by both Bulgaria and Malta. The ICSID tribunal largely agreed with the claimant&#8217;s thesis and Bulgaria ultimately lost the case.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The decision of the arbitration tribunal at the World Bank was issued and served on the parties on Friday, January 5, 2024, but for the 3rd day the Bulgarian Ministry of Finance has remained silent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is important to note that ICSID decisions are final and unappealable. There is no option to appeal the decision of the tribunal before a Bulgarian court, nor before a European one. Against this background, Finance Minister Asen Vassilev tried to transfer the management of these cases to the Ministry of Justice, but met with organized political and media resistance, fueling doubts that part of the huge fees are being absorbed in Bulgaria. <\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"3hmD7PzqH3\"><p><a
