The battle for the legacy of <\/span>Krassimir Kamenov – Karo<\/b>, who was shot in South Africa is happening along all possible lines. The company “Auto Mobile<\/a>” AD <\/span> is an extremely appetizing bite, which, according to many, is one of the keys that could reveal who was behind the shooting of Kamenov. The company’s assets are estimated at about half a billion leva – the commercial value of the objects owned by the company – parking lots and other assets. <\/span><\/p>\n

In its publication, Capital correctly <\/span>notes<\/span><\/a>that the battle for Kamenov’s assets began before his murder. These assets could be one of the leading motives that led to his execution. The company is subject to precautionary measures imposed by the National Revenue Agency and the Commission for Combating Corruption and Corruption worth several million. Before the seizures, however, Auto Mobile, which was then represented by the prosecutor’s witness <\/span>Filip Stoyanov<\/b><\/a>, signs a management contract with Capital<\/span> Invest Bulgaria<\/span><\/a>“. The company is owned by Turkish citizen Mehmet Kahveci.<\/span><\/p>\n

Our sources claim that he was born in the region of Diyarbakir and lived only once within Bulgaria. He entered through the Kapitan Andreevo border checkpoint and stayed no more than 2 hours in the country. Our team is not able to verify this information, but from everything known about Mehmet Kahveci, the suspicion that he is a “straw man” is growing, and behind him are well-known faces from the underground. <\/span><\/p>\n

A large part of the assets of Auto Mobile, probably all parking lots, are leased to Capital Invest Bulgaria at obviously reduced prices for a period of 10 years. According to BIRD, the contract was concluded before the imposition of precautionary measures by the authorities. Thus, the lessee has the right to operate the sites, and the eventual satisfaction of the state’s claims would happen only from the rent that Capital Invest Bulgaria pays to Auto Mobile. <\/span><\/p>\n

Naturally, the state authorities have the right to investigate whether this is a simulated contract and possibly attack it in court, but so far there are no indications that such actions will be taken.<\/span><\/p>\n

At the same time, an increase in the company’s capital by BGN 4 million is underway. Krasimir Kamenov’s ex-wife Svetlana Kamenova has subscribed all new 400,000 registered shares of Auto Mobile<\/a> and thus would become a major shareholder. The main question in this situation is whether the entry of the increase in the Commercial Register will happen. Without a doubt, it would be “over the head” of at least some of Karo’s heirs. <\/span><\/p>\n

<\/div>\n

Six heirs of Karo<\/span><\/h2>\n

After the murders of Kamenov and his wife Gergana Kochanova, he left six heirs. <\/span>There are three children from his last marriage, one of the children is from Lyubomira Kapnilova. We learn about it from the testimony that his former security guards and his former business partner Razmig Chakaryan gave in the prosecutor’s office against Kamenov. <\/span><\/p>\n

Two of the children are from his first marriage to <\/span>Svetlana Kamenova. Prior to the capital increase, these six heirs had to divide 90% of the ownership in Auto Mobile<\/a>. Each of Kamenov’s heirs would be entitled to 15% of the assets. In practice, Kamenova, who initially held 10% of the shares in the company, would probably be able to consolidate the shares of her two sons and thus manage 40% of the shares. Another 45% should be disposed of by Karolina Vladimirova, mother of the late Gergana, who is the guardian of her grandchildren – Karo’s children from his last marriage. Well-informed sources claim that <\/span>the sixth heir does not intend to claim a share of the assets of <\/span>Auto Mobile.<\/span><\/p>\n

However, the shares and rights of the heirs represented by Karolina Vladimirova turned out to be very problematic. Although she was declared the guardian and guardian of her three grandchildren by the Supreme Court of South Africa, Vladimirova encountered significant difficulties in her attempts to enforce this decision before the Bulgarian authorities. The children are citizens of South Africa and Bulgaria, and her eldest grandson also has American citizenship because he was born in the United States. However, due to the fact that the grandfather and mother of the children are American citizens, all Kamenov’s heirs born to Gergana Kochanova are subject to naturalization in the United States. <\/span><\/p>\n

The firstborn son<\/span><\/h2>\n

While the proceedings were still underway in South Africa, Karo’s eldest son, Alexander Krasimirov Kamenov (with his mother Svetlana), also tried to be recognized as a co-guardian and guardian of his brothers and sister from his father’s marriage to Gergana Kochanova. As early as October 4, he wants to be admitted to the proceedings. Karolina Vladimirova’s lawyer informed her that before the court in South Africa, Alexander Kamenov stated that he wanted to ensure that the interests of his half-siblings – Chris, Kaya and Konstantin – were best served while he lived in Bulgaria, so that these children could take advantage of the advantages of their father’s ownership in Bulgaria. <\/span><\/p>\n

Alexander Kamenov argued before the magistrates that he also needed the information in order to facilitate the inclusion of his brothers and sisters in the liquidation of his father’s assets in Bulgaria. While these events are ongoing, Karolina Vladimirova has been declared by the court in South Africa as the executor of Krasimir Kamenov’s will. Between her and Alexander Kamenov, another conflict plane arose, when the heir claimed the urn with his father’s ashes. <\/span><\/p>\n

Despite all these qualities, for which she is authorized by the court in Cape Town, Vladimirova faces difficulties in trying to have her rights recognized in Bulgaria. She has already made two unsuccessful attempts to equate her status as a trustee and guardian from South Africa in front of the municipality of Oborishte. In our country, the matter is regulated by the Code of Private International Law and similar acts, and those for custody are applied directly or, in the worst case, after a declaratory action before the SCC. But the municipality of Oborishte wants Karolina Vladimirova to start a parallel procedure to be declared a guardian and guardian by the Bulgarian authorities. <\/span><\/p>\n

The mayor of the region <\/span>Nikolay Alexandrov<\/span><\/a> signs an act in which he does not take into account the fact that there is an enforceable judicial act of a third country, but insists that the children be heard by the Social Assistance Directorate – Oborishte. Alexandrov commented to BIRD that the answer was prepared by his administration, which should have been competent on the subject. <\/span><\/p>\n

After the elections, Vladimirova made a new attempt to equate her status as a guardian and trustee in Bulgaria with that in South Africa, but the official under <\/span>ESGRAON<\/span> refuses to initiate the procedure. Svetlana Hristova-Stoykova claims that she does not have an original of the court decision from South Africa. The act of the court was translated and legalized with an apostille. He was registered in the registry of the municipality along with a request to the local administration to equate the South African status of <\/span>Vladimirova as a trustee and guardian in Bulgaria. Nevertheless <\/span>Svetlana Hristova insists in front of a person authorized by the grandmother that the children be brought and heard before the municipal administration.<\/span><\/p>\n

If the capital increase of Auto Mobile is entered in the Commercial Register <\/span>Svetlana Kamenova will already have nearly 57% of the capital of the company, which owns 90% of Slatina Kara. Probably, Kamenova’s sons support their mother’s actions, but they undoubtedly harm the rest of the heirs. If the changes are registered, the six heirs of Karo will share not 90% of the <\/span>“Auto Mobile”, and 43%. Thus, each of the six would have 7%. <\/span><\/p>\n

Of course, regardless of whether Karolina Vladimirova is a trustee of heirs with a share of 45% or 21%, she must have such an indisputably proclaimed quality in our country. For the time being, her status as a guardian and trustee is not recognized by the Bulgarian institutions and it would be more difficult for her to attack the capital increase in court. <\/span><\/p>\n

It is likely that Kamenova made an attempt to buy out the shares of Karo’s children from his last marriage, but if this is the case, in no case did she offer them an amount higher than the one with which she was trying to increase the company’s capital.
