The state-owned Bulgargaz does not collect BGN 37 million in liabilities of Ahmed Dogan’s TPP

The assembly, through the Ministry of Energy and respectively the state-owned Bulgargaz, does not take action to forcibly collect the awarded over BGN 37 million. liabilities of the better known as TPP Dogan (TPP Varna), which through Sigda Investment is 50% owned by Ahmed Dogan, and thus protects the honorary chairman of the MRF and his business. This became clear from an answer to our question to the state-owned company.

The “coordination of an agreement“, instead of proceeding with enforcement. The presence of an issued Writ of execution suggests exactly that – whether directed at an individual or a legal entity. To put it in simple words – if a writ of execution has been issued against you for unpaid 300 leva heating (for example), a private bailiff (PEA) will directly “pull” the amount due from your bills, along with fat fees and fees. Therefore, the state-owned company has nothing to “coordinate” with Dogan’s TPP, but should be directly satisfied for the amounts due. Obviously, however, Bulgargaz has not activated the PEA against ” TPP Varna“, which is extremely strange.

Whether we will pay the masraf again remains to be seen.

Another lawsuit is currently underway, filed by the state-owned Bulgargaz for more than BGN 3 million. unpaid liabilities by TPP Varna. With them, the liabilities of Dogan’s TPP will exceed the amount of BGN 40 million.

A court decision, a writ of execution and agree?

In response to the questions related to TPP Varna EAD, we remind you that the awarded receivables of Bulgargaz EAD from TPP Varna EAD are duly secured, and the value of the collateral provided covers them in full. On the basis of the court decision on commercial case 284/2022 on the inventory of the General Assembly-Varna, a writ of execution was issued against the debtor in favor of Bulgargaz EAD. At present, Bulgargaz EAD and TPP Varna EAD are in the process of agreeing an agreement for the payment of the amounts due in accordance with the court decision. The awarded receivables of Bulgargaz EAD stem from a contract for the supply of natural gas with TPP Varna EAD. Bulgargaz EAD does not have and has not had contractual relations with Ahmed Dogan personally as an individual. According to the legislation in force in the country, at the moment there is no legal basis for Bulgargaz EAD to initiate enforcement actions against him either in his personal capacity or in his capacity as a member of the Board of Directors of TPP Varna EAD.
