Mondeshki – “Peevski’s Trojan Horse”, filled with millions by FIB

Lawyer Momchil Mondeshki received BGN 16.3 million between 2014 and 2018 from First Investment Bank (FIB)), also known as FiBank, without appearing at any of their cases. who gained popularity in the case . More details about them are available below in our publication. In this “elite” group of “brokers of influence” falls and lawyer Momchil Petkov Mondeshki.

A check by the NRA reveals BGN 16.3 million. by FIB

Momchil Mondeshki was checked by the NRA as an individual for the period from January 1, 2014 to December 31, 2018, i.e. fora 5-year period. The inspection is carried out by the territorial directorate in Veliko Tarnovo and was carried out from 26.06.2019 to 30.09.2020. Inspection report under No PF-04001119000711-073-001/30.09.2020 sheds light on the actual scope, with whom Mondeshki works. Only through In 2014, as a freshly registered lawyer, he received over BGN 9 million. fees from FIB. For the period 16.05.2014 – 31.12.2014 Mondeshki has received a total of BGN 16,302,450.27 from FIB.

A small but significant detail is that when FIB started pouring money into the accounts of the freshly registered lawyer, he enjoyed the reputation of one of the most successful brokers in the Sofia City Court (SCC). It is very close to Vladimira Yaneva and next to Rumyana Chenalova. Proximity verified through records from #ЯневаГейт. FIB’s payments give indications that Mondeshki has apparently “lobbied” on their court cases in Sofia, Stara Zagora, and probably in Shumen, and it is very possible that this happened with the protection and contacts of the two judges.

Apparently, the #Yaneva Gate scandal that started

in early November 2015, he did not fatally influence Mondeshki and did not scare FIB so much that they would give up his “services”. In 2015 and 2016, Mondeshki’s revenues from FIB were more modest, about half a million leva, but in 2017 he received BGN 3,566,996 from the bank, and in 2018 BGN 1,349,522 .

For 5 years Momchil Mondeshki receives 42 payments from FIB. Their value varies from several tens of thousands of leva (at least) to the impressive over BGN 1.5 million one-time payment to his bank account. Detailed list at the end of the text.

Advance payment of EUR 1.55 million Lv. Mondeshki ‘s

It is very curious what exactly FIB paid Mondeshki for, provided that even today no one has seen the lawyer in the courtroom, as a legal representative. He has not appeared in the cases of FIB or in any other case. The only qualities in which Mondeshki appeared in the courtroom was as a defendant and as a convict. Despite his biography as a rehabilitated criminal, he received millions from FIB. These are officially fees for his lawyer services – Consultations on the cases related to the Bank’s cases.

Mondeshki “advises” FIB on how to avoid the return of the stolen 22 million euros from Romania

In January 2017 Momchil Mondeshki and First Investment Bank (FIB) agree that he will receive a total of EUR 2 755 000 excluding VAT if he manages to help the bank avoid the return of the stolen EUR 22 million. Mondeshki is committed to dealing with The lawsuits against FIB, filed by the Ministry of Agriculture and Food of the Republic of Romania, through the Agency for Payment and Participation in Agriculture (APIA). This is confirmed by a leaked copy of the consulting contract concluded between the lawyer and the bank.

The agreed remuneration for Mondeshki in the contract under items 1 to 3 inclusive amounts to EUR 2 200 000 excluding VAT. For the implementation of item 1.1.4 are agreed EUR 450 000 excluding VAT plus another EUR 25 000 without VAT for execution within a certain period. The point in question requires the achievement of “positive” for the contracting authority final decisions in Commercial Case No 2451/2016 on the inventory of the Supreme Court of Cassation, with the subject of an application for annulment of the Order of June 9, 2014 under the city of Sofia. e. No 4919/2014 of the SCC. I d.o., I Chamber, confirmed by decision No 937 of 8 May 2015 No 4018/2014 of the Sofia Court of Appeal, Civil Division, 2nd Chamber, which was not admitted to cassation appeal by Order No 646 of 27 July 2016 under item No 2844/2015 of the SCC. For success in this commercial case No. 2451/2016 of the Supreme Court of Cassation, the parties agree that it means a ruling by the court by a final judicial decision, which leaves the application for annulment inadmissible as inadmissible. For success under item 1.1.6 have been agreed separately more EUR 100 000 excluding VAT.

of the Sofia City Court.

The contract envisages that three days after the signing, Momchil Mondeshki will receive an advance of EUR 650,000 excluding VAT from FIB. 

In 2019, however, FIB finally lost

and the cost of enforcement against the bank. Mondeshki is committed to stopping the actions of the private enforcement agent Ulyana Dimolarova against FIB, but this does not happen either. At that time, FIB was faced with the hypothesis to transfer over EUR 22 million to the Romanian Ministry of Agriculture a bank guarantee owed as collateral for a food transaction. In practice, the bank engaged Mondeshki for 12% of the amount sought by the Romanians, but he did not achieve success. What else but a corrupt deal could be hiding behind this contract? Subsequently, FIB announced

that they had won 3 cases before the Romanian court and had lifted the distraints in their accounts with the BNB, but failed before the Supreme Court of Cassation with their consultant Mondeški.

The FIB documents show that on 12.06.2014 they paid Mondeshki BGN 977,915 for “legal protection and court” in civil cases 4919/2014, 4920/2014, 4921/2014, all led by FIB against VM Corporation

. Mondeshki received almost the same amount on 13.06.2014 for consulting FIB on a commercial case, again against VM Corporation. The company is a participant in the infamous scheme of draining the Romanian agricultural paying agency APIA. In 2015, the owner of the company – Valeri Miloradov Petrov AnnouncedNot him, but FIB operated with his company. First Investment Bank gives bank guarantees amounting to 31 million euros to the company to participate in a tender for the supply of oil and flour to the poor, organized by the Romanian agency. The auction was won by VM Corporation, the money was taken in advance, but food was not delivered. The deal became infamous as The Biggest Single Theft of EU Funds, carried out with the complicity of the bank. The damage to the Romanian state is at least EUR 22 million.

Valuable “consultations” costing FIB millions

One of the contracts between Momchil Mondeshki и FIB, for “consultations /orally in telephone conversations or holding meetings or in writing through a legal opinion/” is typical, is not for specific cases and is worth 1 224 000 EUR with VAT, payable within one week of its signing on 07.06.2017, Mondeshki immediately issued an invoice and the very next day, on 08.06.2017, received the amount on his account.

What do we know about other contracts? For example, a consulting contract 074470 of 20.06.2014 worth  1 100 000 EUR in commercial case 565/2011 in the General Assembly of Stara Zagora. The case is a proceeding in bankruptcy of “Stenstroy Engineering‘ and FIB claimed an amount of EUR 8 650 000. By virtue of promissory note from 22.08.2008 “Stenstroy Engineering” Ltd. has undertaken unconditionally and irrevocablely, upon presentation of the promissory note by 30.10.2012, to pay to First Investment Bank AD an amount of EUR 8 650 000. Mondeshki is included when the bankruptcy estate is distributed. The amount of the fee of BGN 1 100 000 suggests that in connection with this case some corrupt transaction has been effected by which the bank was benefited in the distribution of the bankruptcy estate. The legal representation itself in such a commercial case with a material interest of about BGN 16,867,500. The minimum legal fee should be in the range between BGN 140,000 and just under BGN 300,000, depending on the stage of bankruptcy in which the lawyer is involved. In history, however, there is probably no consulting fee of BGN 1,100,000. in a case with a material interest of BGN 16 954 000

The situation with the fees paid by FIB to Mondeshki becomes even more disturbing, with the fee again of BGN 1,100,000  . paid by contract 074471 for consultations in enforcement case 2085/2014 PEA Stoyan Yakimov. The latter is very close to Delyan Peevski and has long been a priority PEA in
the sale
of Corpbank’s assets. According to insiders, he studied law in the same stream with Peevski’s lawyer Alexander Angelov. It is also an indisputable fact that Kristi Marinova, appointed trustee in bankruptcy of CCB, was Mondeshki’s accountant, and Angel Donov, also a trustee in bankruptcy at the bank, worked together on cases of the Mondeshki family. Again, apparently the sacred amount of BGN 1,100,000  . was paid to lawyer Mondeshki from FIB under a contract 074472 for consultation on commercial case 212/2014 of the General Assembly of Stara Zagora. The case is again a bankruptcy proceeding of “Remotex – Radnevo” EAD. The history of FIB and Remotex is public. In 2014, the Bank acquires the assets of the bankrupt company. According to publications from that time, FIB paid at auction the amount of nearly 9 mln. Lv. and becomes the owner of the major part of the assets of the bankrupt company. The bank has lent the plant for the repair of heavy mining equipment with nearly 16m euros. Lv. before the insolvency procedure begins. The question is why FIB paid the sum of BGN 1 100 000 to Mondeshki in connection with this case.

We sought a comment from FIB on Mondeshki’s consulting fees, but such did not follow. The bank noted that its activities are subject to serious control, but did not explain why they use the services of a rehabilitated criminal.

Influence brokers

In the last 15 years of our transition, the judiciary in Bulgaria apparently functions with the help of the so-called “influence brokers”.“. One of the names that became a byword in the judicial circles after 2009 is that of Krasimir Georgiev – Krasio the Black. It continues to be relevant in circles and today is considered a link between shady businessmen and administrative judges. In recent years, he has often been found in the company of Borislav Petrov Lazarov, better known as Bobby Noverata.

All these names, however, pale in comparison to the international scale and the fees in the amount of tens of millions received by the lawyer Momchil Petkov Mondeshki. Probably in connection with these commitments, Podesta started his business venture with Peevski’s “Trojan horse” – lawyer Momchil Mondeshki.

From FIB, but also from Peevski…

An interesting fact is that in 2016 Mondeshki was paid by
Vodstroy BGN 98
600 000. They are an account of LUK REIT under a legal services contract from November 23, 2016. The company is associated with Ivan Mirinski and Delyan Peevski.

This comes after the “Trojan” gained national notoriety in the course of the #Yaneva Gate scandal, when he was lit up as a participant in the conversations

between the then President of the Sofia City Court Vladislava Yaneva and the judge Rumyana Chenalova. Subsequently, he turned out to be perhaps the most key figure for Corpbank AD after its bankruptcy, in the process of looting the assets by corpulent firms.
