How the Supreme Administrative Court of Justice (SAC) hacked a decision of the Court of Justice of the EU on pollution from thermal power plants to please consultant Kovachki

Yesterday at noon, the Court of Justice of the European Union (CJEU) issued

a key ruling according to which TPP Maritsa East 2 was not entitled to a derogationbecause (in a nutshell) it pollutes the air and the environment excessively. This is undoubtedly news of the first magnitude, with huge implications for the energy sector and the Recovery Plan (HEU), from which Bulgaria hopes to receive billions of euros. However, we want to focus on Several important aspects that have so far passed between the drops in the coverage of the news – as well as to give a slightly broader framework to the case.

The complex permit subject to the complaint to the Supreme Administrative Court (which made the request to the ECJ) was issued on 21.12.2018 by the head of the EEA Rositsa Karamfilova — current eco-minister. She is also the person who issued all the permits. TPPs consulted by Kovachki in the last few years. By her own admission, only on paper, i.e. during her life she has not set foot in the TPPs in question. To see, for example, that the smoke was black and not white – as the head of the Brickell.

And now it’s getting interesting. On February 14, there was to be a final hearing on the case. However, the SAC postponed the case, because (again surprised!) not only the boss of Brickell, well, the lawyer of the company are simultaneously in hospital. And whether the sick notes are fake – a devil knows, lately there is something like an epidemic of postponement of cases because of such sheets. Reference – the case for Wolfsair was postponed

. But it gets worse, as the optimist said.. Because the Supreme Administrative Court not only postponed the case until March 14, but only a few days after February 14 stopped it to wait for the preliminary ruling in the ECJ. However, this It is very confusing In Bulgaria, because since the beginning of February the CJEU has publicly announced that it will come up with a decision on March 9. That is, since the Supreme Court judges know about the case in the CJEU, then by definition they should also know that it has already been announced to be resolved. And that by the date of the next meeting – 14.03.2023 – the CJEU’s decision will already be a fact in the legal world. They need to know, but they’re pretending to be three-and-half?

What does all this mean? Well, it just means that YOU has found a fabricated and frivolous reason to chicane the case. Otherwise, as early as March 14, it would have been announced for decision – in view of the CJEU’s decision, Kovachki (pardon, Kennedy) He would have lost the case in the last instance. And now Kennedy (sorry, Kovachki) gets delay for unclear when. Our observations on the work of the Supreme Administrative Court over the years show that the Chambers are extremely slow to restart their cases after the ECJ has ruled on preliminary questions. That is, Kovachki / Kennedy received another extension, and with an unclear long horizon.

Americans to the rescue, or maybe not.

But when we said a delay, it is right to pay attention to something else. Already at the end of November, an “American investor” told the CPC that he wanted to buy “Brickel

” and “Bobov Dol

” – the smoking pearls in the stinking crown of the Empire. Of course, the Mother-of-GERB (i.e. the CPC with his boss) pronounced a record fast, in just 2 weeks. From publication In Capital we understand, however, that the American in question is more of an “affaire” with a controversial reputation. And what to see to date – in the Commercial Register no entry requested of the “American” as the new owner of the two smoking thermal power plants. Was the man afraid of Magnitsky 3.0 – And who exactly will be magnetized? We will soon find out, dear readers. Indicative in this respect, however, are Two facts. First, Kovachki’s media offensive about a month ago and the refrain chanted by him “I’m not afraid of Magnitsky.” And second and much more important – the action of the European Public Prosecutor’s Office in the last few days, on the occasion of the damage of 74 million euros inflicted on the European budget by the thermal power plants of Roy Kennedy, Erlene Rodriguez, Panagiotis, Poppleton, etc. The latter was revealed, by the way, by an international team of journalists with the participation of Dimitar Stoyanov, who presented the revelations to the Audit Committee in the National Assembly, and from there they sent them as a signal to Kovesi.
