AntiRecord: The Prosecutor’s Office and the Ministry of Interior Sentenced to Pay 82 Million to Lev Ins

In the late hours of December 7, the absolute record for compensation that the Prosecutor’s Office and the Ministry of Interior have to pay to a company affected by their actions was broken. The two law enforcement institutions must reach for joint and several compensation under the SMLDA in the amount of 48 million and 300 thousand leva, which with the interest for the last 7 years swell to 82 million and 300 thousand leva. That is, to reach into the taxpayer’s pocket.

The verdict is that of a panel of the Pernik District Court, which after nearly 4 years of court proceedings, sentenced the Prosecutor’s Office and the Ministry of Interior to pay the injured company Lev Ins the record amount. 63,000 leva were also awarded. registry expenses. For the comfort of the Prosecutor’s Office, it was also awarded costs – in the amount of 11 leva and 83 stotinki.

Either way, the company was once (in 2010) seriously damaged by a prosecutorial-police raid, for which the court is now awarding the compensation due. What is unique about this case, without going into the depths of the long tens of pages of judgment, is actually the award of non-pecuniary damage of 300 thousand leva, to undermine the prestige of the company. We recall that recently Gold Leasing also condemned

PRB for non-pecuniary damage, which together with the property court estimated at nearly BGN 2 million.. For that final judgment, as in the present case, the first We reported we. Apropos, our reference showed that the Treasury has not paid the company to this day.

The very history of this case is also curious. Filed in 2015 initially in the SCC, The case for 4 years is “Dzhurka” (said by Georgicholakovski), while absolutely all judges (and they are not few) in the civil, commercial and criminal divisions of the court. Why – but because the defendant in the case is the Sofia City Court itself, as in 2010-11 it approved some of the pre-trial actions (GA Pernik, however, rejected the claim against the SCC).

And so we come to 2019, when from nowhere the case was sent to the Pernik District Court, after the removal of all judges from the Sofia City Court. But also in Pernik The case continues to have an interesting fate.. It was originally assigned to Judge Renny Kovachka. At the end of 2021, when the case was coming to an end, however, Judge Kovachka was seconded to the SAS. And so the case is taken over by Judge Mihail Malchev, who on May 12 this year announces for decision. Malchev himself is also a seconded regional judge, recently in the General Assembly Pernik. Okay, but soon after he announced the case for decision, he himself was also seconded, this time to the SCC. And since the SCC itself is a defendant in the case, this gives reason to Judge Malchev to take away.

A new random distribution follows, and the case ended up with Judge Maria Milusheva – also seconded from the district level. Interestingly, however, she is also a former prosecutor from the district level. While following these interesting developments in the case (and before the decision came out), in view of everything described so far in our country the suspicion that someoneWHO may be trying to help the Casketura to win the case ex officio (whether by prescription or for another technical reason) was intensified by intensively “djurka” judges. We are very glad to see now that even if there were such pushes, they did not work.

The decision of the Pernik court is extremely detailed, legally sound and most importantly – fair.
