BFSA Cracks Up Lawsuits in Favor of Kapitan Andreevo’s “Golden Laboratory”

The Bulgarian Food Safety Agency (BFSA) makes inexplicable omissions in the lawsuits of Kapitan Andreevo’s infamous “golden laboratory” “Eurolab 2011”, related

to the no less scandalous Ami, Curo and Taki. BFSA does not deposit 70 lv. state fee for cassation appeal of a decision. Also, BFSA does not deposit 30 lv. fee for appealing from an order in another case. In addition, a representative of the The BFSA did not appear at 4 consecutive hearings in the cases of “Eurolab 2011

” in the Administrative Court of Sofia-city (ACSC).

The gaps in the cases began to happen after the leadership of the BFSA was replaced by the caretaker government of President Rumen Radev. On October 5, 2022, the Executive Director of the BFSA appointed Hristo Valchanov, who previously held the post of Deputy Executive Director of the Agency, also appointed by the caretaker government.

On the same day, the former head of the BFSA Prof. Hristo Daskalov
states
:

“This is the person who at the end of 2021 started the procedure for a new 10-year contract with a private company at the border. You know all the facts about the Kapitan Andreevo case. You know about the threats, about the attempts at bribery, about the black campaign against all of us who “encroached” on the favorite company of Borisov’s power. You know about the party functionaries of GERB associated with the company at the border.”

Hristo Valchanov was Executive Director of the Bulgarian Food Safety Agency from July 2021 to January 2022. This is the period in which the scandalous auction for the rental of Kapitan Andreevo’s premises was held and on 31.12.2021 a contract was signed with Eurolab 2011

“. The bids for the auction were then submitted at 21:00 on 31.12.2021, and the contract was signed at 22:26 on 31/12/2021. by Valchanov’s deputy.

Irresponsibility, incompetence or something else?

The responsibility for the inexplicable omissions in the Eurolab 2011 lawsuits lies entirely with the new leadership of the Bulgarian Food Safety Agency, appointed by the caretaker government of President Rumen Radev.

On 04.10.2022 , the then Head of the Bulgarian Food Safety Agency Prof. Hristo Daskalov signed a statement of claim for filing a commercial lawsuit in the SCC against Eurolab 2011, in order to declare the contract signed on 31.12.2021 null and void. The next day, prof. Daskalov was fired by the caretaker agriculture minister, and the new-old boss returned to his place Hristo Valchanov cancels/withdraws the filing of the application in court. Cool, isn’t it?

On 21.10.2022 , a representative of the BFSA did not appear At an open session on Adm. lawsuit 7617/2022 of the ACSC. In the minutes of the hearing it is written: “the defendant – BFSA, regularly summoned, does not send a representative”.

On 02.11.2022 BFSA does not appear At a meeting on Adm. lawsuit

of the ACSC.

On 07.11.2022 The court dismissed the private complaint of the BFSA against the Order under Adm. lawsuit 8426/2022 of the ACSC. The reason – the due 30 BGN state fee is not paid by the BFSA. In addition, the ruling could have been appealed within 7 days to the Supreme Administrative Court, but this was not done either.

On 21.11.2022, the deadline specified by the court expires, within which the BFSA had to provide evidence for paid BGN 70 state fee for a cassation appeal of the BFSA against a Decision on Adm. lawsuit 6183/2022 of the ACSC. That’s not happening.

On 24.11.2022 The BFSA did not appear at a hearing in Case 8824/2022

of the ACSC.

On 30.11.2022 The Sofia City Administrative Court rejected the cassation complaint of the Bulgarian Food Safety Agency against the Decision on Adm. lawsuit 6183/2022 of the ACSC. The ruling is subject to appeal within 7 days before the Supreme Administrative Court, but we can guess what the outcome will be.

Actions, or rather inactions of the BFSA on adm. lawsuit 6183/2022

of the Sofia City Court and the last ruling of the court on 30.11.2022, in fact, leave Kapitan Andreevo’s infamous “golden laboratory” “Eurolab 2011″ in the premises rented by the company at the border.

The first decision in this same case 6183/2022

of the ACSC was that of Judge Vanina Koleva

, which stopped the preliminary execution of the order of the then Director of the BFSA prof. Hristo Daskalov for the removal of the “golden laboratory” from Kapitan Andreevo. Afterwards We revealed

that Judge Koleva had not declared construction.

We are yet to find out what will be the outcome of the remaining unfinished cases of “Eurolab 2011” against the state. Our reference showed that the next hearings in two of the cases are already scheduled for 24 and 25 January 2023.

Taki-Maki and the “golden feeders”

The scandalous “golden laboratory” of Kapitan Andreevo “Eurolab 2011” is associated with the no less infamous “golden pool” and “golden parking“. The common thing is that they are controlled by persons associated with the drug kingpin Christoforos Amanatidis – Taki, Krasimir Kamenov – Curo and Razmig Kerope Chakarian – Well, an

“Golden feeders” do not even try to distinguish themselves from each other and have
authorized
the same lawyer Ivaylo Velinov to represent them before the Registry Agency. At the end of September 2022, he submitted their financial statements for 2021.

From an earlier
investigation
of the BIRD.BG it became known that the company “Eurolab 2011”, which owns the gold laboratory, has worked with an invalid accreditation certificate, but the BFSA has turned a blind eye to this fact.

Recently, an order of the Director of the Bulgarian Food Safety Agency revealed that at the initiative of the Prosecutor’s Office, the BFSA unsealed its archive

at the Kapitan Andreevo border checkpoint, sealed under the government of “Continuing the Change”.

Despite the threats of the government, DANS has not yet started inspections at the premises of the laboratory at the border, which were declared an object of national security. The missing cameras are not installed.

In September 2022, the European Commission concluded

that “Kapitan Andreevo does not meet the minimum requirements for checkpoints for goods and animals” and that European legislation on the control of cargo entering the EU through Kapitan Andreevo does not apply.

On Friday, December 2, 2022, it was officially
announced
, that the Netherlands is blocking Bulgaria for Schengen and that Austria is expected to do the same. According to Deputy Prime Minister and Foreign Minister Wopke Hoekstra “
The Netherlands
can only reconsider the issue when it becomes clear that Bulgaria has a state capable of tackling corruption and organised crime.”

Against this background, the Bulgarian authorities are stubborn not to see the obvious. and not to hear the deafening. Because in translation from diplomatic to Baiganyov’s language, Rutte’s message reads like this: “As long as you have given your most important border checkpoint to gloomy underground figures from the SIC, VIS and so on, so that they can unhindered flood the whole of Europe with drugs – Schengen you will not see. And you don’t deserve to see.”
